1. Agreement to Terms

Welcome to Educare International. These Terms of Service ("Terms") govern your access to and use of our website, services, and products. By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use our services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Services

Educare International provides educational consulting services, including but not limited to:

  • University and college application assistance
  • Course and program recommendations
  • Visa application support and guidance
  • Scholarship and financial aid assistance
  • Career counseling and guidance
  • Pre-departure orientation and support
  • Student accommodation assistance
  • IELTS and other test preparation guidance

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

3. User Accounts

3.1 Account Registration

To access certain features of our services, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including if we reasonably believe you have violated these Terms. You may also terminate your account at any time by contacting us.

4. User Responsibilities and Conduct

When using our services, you agree to:

  • Provide truthful and accurate information in all applications and communications
  • Comply with all applicable laws and regulations
  • Respect the intellectual property rights of Educare International and third parties
  • Not engage in any fraudulent, abusive, or illegal activities
  • Not interfere with or disrupt the operation of our services
  • Not attempt to gain unauthorized access to our systems or networks
  • Not use our services to transmit viruses, malware, or other harmful code
  • Not impersonate any person or entity
  • Attend scheduled appointments and meetings or provide reasonable notice of cancellation

5. Service Fees and Payment

5.1 Service Fees

Certain services provided by Educare International require payment of fees. All fees are clearly communicated before you engage our services. Fees are subject to change with prior notice.

5.2 Payment Terms

Payment must be made according to the payment schedule agreed upon in your service contract. We accept various payment methods as specified during the registration process.

5.3 Refund Policy

Our refund policy varies depending on the service provided and the stage of the application process. Specific refund terms will be outlined in your service agreement. Generally:

  • Initial consultation fees are non-refundable
  • Partial refunds may be available if services are cancelled before substantial work has commenced
  • No refunds are provided once applications have been submitted to educational institutions
  • Third-party fees (application fees, visa fees, etc.) are non-refundable

5.4 Late Payments

Late payments may result in suspension of services. We reserve the right to charge interest on overdue payments at the rate of 1.5% per month or the maximum rate permitted by law, whichever is lower.

6. Application Process

6.1 No Guarantee of Admission

While we provide expert guidance and support throughout the application process, we cannot guarantee admission to any educational institution. Final admission decisions are made solely by the respective universities and colleges.

6.2 Client Cooperation

Successful applications require your active participation and cooperation. You must provide all required documents and information in a timely manner and respond promptly to our requests for additional information.

6.3 Document Authenticity

You represent and warrant that all documents and information you provide are genuine, accurate, and complete. Submission of false or fraudulent documents may result in application rejection, legal consequences, and immediate termination of our services without refund.

6.4 Deadlines

You are responsible for ensuring that all required materials are submitted within the deadlines we establish. Failure to meet deadlines may result in missed application opportunities.

7. Intellectual Property Rights

7.1 Our Content

All content on our website and in our materials, including text, graphics, logos, images, videos, and software, is the property of Educare International or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of our services without our prior written consent.

7.3 User Content

By submitting content to us (such as applications, essays, or testimonials), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purposes of providing our services and marketing activities.

8. Third-Party Services and Links

Our services may contain links to third-party websites, services, or applications that are not owned or controlled by Educare International. We are not responsible for the content, privacy policies, or practices of third-party sites. Your use of third-party services is at your own risk.

When you apply to educational institutions through our services, you may also be subject to the terms and conditions of those institutions.

9. Disclaimers and Limitations of Liability

9.1 Service Disclaimer

Our services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation of our services or the information, content, or materials included therein.

9.2 No Professional Advice

While our consultants are experienced professionals, the information and advice we provide should not be considered as legal, financial, or immigration advice. You should consult with appropriate licensed professionals for such matters.

9.3 Limitation of Liability

To the fullest extent permitted by law, Educare International shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from:

  • Your use or inability to use our services
  • Unauthorized access to or alteration of your data
  • Rejection of your application by educational institutions
  • Denial of visa applications
  • Any other matter relating to our services

Our total liability to you for all claims arising from or related to our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Educare International, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your use of our services
  • Any false or misleading information you provide

11. Confidentiality

We are committed to maintaining the confidentiality of your personal and application information. However, you acknowledge that:

  • We must share your information with educational institutions as part of the application process
  • We may share information with third-party service providers who assist in our operations
  • We may be required to disclose information in response to legal process or government requests

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

12.2 Arbitration

Any dispute arising out of or relating to these Terms or our services shall first be attempted to be resolved through good faith negotiations. If negotiations fail, the dispute shall be submitted to binding arbitration in Nairobi, Kenya, in accordance with the Arbitration Act of Kenya.

12.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Educare International individually. You waive any right to participate in a class action or representative action.

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, government regulations, natural disasters, or infrastructure failures.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Educare International regarding your use of our services and supersede all prior agreements and understandings.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after such changes constitutes your acceptance of the new Terms.
